1. Scope of Services
Heal Now India provides medical tourism facilitation services, which include:
- Connecting patients with hospitals and healthcare providers that hold licences, accreditations, or certifications as represented by the respective institutions. Heal Now India does not independently verify, audit, or guarantee the quality, safety, accreditation status, or medical performance of any healthcare provider.
- Obtaining treatment cost estimates and hospital appointment confirmations on behalf of patients
- Assisting in obtaining hospital invitation letters where available. Heal Now India does not guarantee visa approval, visa processing times, or entry into India, as all immigration decisions are made solely by the relevant government authorities.
- Coordinating travel logistics including airport pickup and local transport
- Arranging accommodation near the patient's hospital
- Facilitating post-treatment follow-up communications with the hospital
These services are provided as a facilitation service only. Heal Now India is not responsible for and does not warrant the quality, safety, success or outcomes of any medical treatment provided by any hospital or doctor. The medical treatment relationship is solely between the patient and the treating hospital/physician.
2. Independent Medical Judgment
All treatment decisions โ including the choice of hospital, physician, procedure, and treatment plan โ remain solely the responsibility of the patient and the treating healthcare provider. Heal Now India does not recommend, prescribe, or determine any medical treatment. Any information we provide about hospitals or treatments is for general informational purposes only and does not constitute medical advice.
3. Patient Responsibilities
By using our services, you agree to:
- Provide accurate, complete and up-to-date medical information and reports
- Disclose any allergies, medications or conditions relevant to your treatment
- Follow all pre-travel instructions provided by the hospital
- Obtain valid travel insurance covering medical emergencies abroad prior to travel
- Ensure your passport has a minimum of 6 months validity
- Make all payments to the hospital directly as instructed
- Comply with the hospital's own terms, rules and discharge procedures
4. Treatment Estimates
Any treatment estimates, quotations, or indicative costs obtained from hospitals are provided for informational purposes only. Such estimates may change following medical evaluation, diagnostic testing, physician review, changes in treatment requirements, or exchange rate fluctuations. The final cost of treatment is determined solely by the treating hospital and may differ from any initial estimate. Heal Now India is not responsible for any difference between an estimate and the final amount charged by the hospital. Hospitals and physicians may also revise treatment recommendations following in-person examination, diagnostic testing, or further medical review.
5. Fees and Payment
Facilitation service: Heal Now India does not charge patients a direct facilitation fee for standard services. Our service is supported by arrangements with our hospital network partners. Heal Now India may receive referral fees, service fees, or other compensation from hospitals or healthcare providers within its network. Such arrangements do not constitute medical recommendations and do not affect the patient's freedom to choose any healthcare provider. We do not add fees to hospital-quoted treatment costs.
Hospital payments: All treatment costs are paid directly to the hospital by the patient. Heal Now India does not collect, hold or process treatment payments on behalf of patients or hospitals.
Ancillary services: Where Heal Now India arranges specific paid ancillary services on your behalf (e.g., specialised interpretation, specific accommodation arrangements), the applicable fee will be clearly communicated and agreed in writing before any charge is incurred.
6. Medical Information Accuracy
Heal Now India relies on information provided by the patient and their existing healthcare providers. We are not responsible for delays, inaccurate cost estimates, changes in treatment recommendations, or any other issues arising from incomplete, inaccurate, or outdated information supplied by the patient or their referring physician.
7. Cancellation and Changes
Patient-initiated cancellation: If you need to cancel or postpone your travel, notify us as early as possible via WhatsApp or email. We will use reasonable efforts to reschedule your hospital appointment. However, the hospital's own cancellation and rescheduling policies will apply to any hospital deposits or pre-payments you have made directly to the hospital.
Accommodation and transport: Cancellation policies for accommodation and transport bookings made on your behalf will be communicated at the time of booking. We will endeavour to minimise any cancellation charges.
Force majeure: Heal Now India is not liable for service disruptions caused by events beyond our reasonable control, including visa refusals, flight cancellations, natural disasters, or changes in hospital availability.
8. Limitation of Liability
Heal Now India acts solely as a facilitation intermediary with no ownership, management or operational control over any hospital, clinic, physician, transport provider or accommodation provider. To the fullest extent permitted by applicable law:
- Medical outcomes: Heal Now India is not liable for any medical outcomes, complications, treatment-related injuries, or other clinical events arising from treatment received from any hospital or physician. The clinical relationship is solely between you and the treating hospital and physician.
- Third-party providers: Heal Now India is not liable for any act, omission, negligence or default of any hospital, doctor, transport provider, accommodation provider or any other third party engaged in connection with your treatment journey.
- Travel and stay: Heal Now India is not liable for any loss, injury, theft or damage arising during your travel to or from India, or at any point during your stay in India.
- Information reliance: Information provided on our website and in our communications is for general guidance only. We are not liable for any loss arising from reliance on such information, which may be subject to change without notice.
- Indirect losses: We are not responsible for indirect or consequential losses, such as lost income, business interruption, loss of opportunity, emotional distress, or similar losses that are not a direct result of our own conduct.
- Aggregate liability cap: To the extent Heal Now India is found liable for any claim that cannot legally be excluded, our total aggregate liability shall not exceed the amount paid directly by the patient to Heal Now India for the specific facilitation service giving rise to the claim, or INR 10,000, whichever is greater.
- No outcome warranty: We make no representation or warranty that any hospital, doctor, treatment or procedure will achieve a particular medical result or outcome.
Nothing in these Terms limits or excludes liability for death or personal injury caused by Heal Now India's own proven fraud or wilful misconduct, or any liability that cannot lawfully be excluded under applicable law.
9. Emergency Services
Heal Now India does not provide emergency medical services. In a medical emergency, patients should immediately contact local emergency services (India national emergency number: 112) or seek urgent assistance directly from their treating hospital. Heal Now India cannot guarantee availability or response outside of normal working hours.
10. Translation and Interpretation
Where translation or interpretation assistance is provided, it is offered for convenience only. Heal Now India does not guarantee the accuracy or completeness of translated communications. Patients should seek clarification directly from their treating healthcare provider whenever necessary and should not rely solely on translated communications for medical decision-making.
11. Website Information
Information provided on healnowindia.com is intended for general informational purposes only and should not be interpreted as medical advice, diagnosis, treatment recommendations, or professional healthcare guidance. Content on this website is subject to change without notice and may not reflect the most current medical standards or hospital information.
12. Data Privacy and International Transfers
By submitting medical information through Heal Now India โ including medical reports, diagnostic scans, pathology results, passport details, and personal contact information โ you consent to the transfer and sharing of that information with hospitals, physicians, diagnostic providers, visa support partners, and other service providers involved in coordinating your treatment journey. Such information may be transferred across international borders, including to India, where required for service delivery.
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Because medical information may be shared with healthcare providers for treatment coordination purposes, patients are encouraged to review our Privacy Policy carefully before using our services.
13. Legal Compliance and Sanctions
Heal Now India reserves the right to refuse or discontinue services where required by applicable law, sanctions regulations, immigration requirements, fraud prevention measures, or hospital compliance policies. This includes situations where providing services may conflict with the laws of India, the patient's country of residence, or any applicable international sanctions regime.
14. Intellectual Property
All content on healnowindia.com โ including text, graphics, logos, and design โ is the property of Heal Now India or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute or create derivative works from any content on this website without our prior written consent.
15. Governing Law and Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of India. Nothing in this clause affects any mandatory statutory rights you may have under the laws of your country of habitual residence that cannot be excluded or overridden by contract.
In the event of any dispute or complaint, the parties agree to the following process in order:
- Good-faith negotiation: Contact us first at care@healnowindia.com. We will use reasonable efforts to resolve the matter amicably within 30 days of receiving written notice.
- Mediation: If the dispute cannot be resolved through negotiation, the parties agree to submit to mediation before initiating legal proceedings, with a mutually agreed mediator.
- Litigation: If mediation is unsuccessful, any disputes shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.
16. Entire Agreement
These Terms, together with our Privacy Policy and any written communications expressly incorporated by reference, constitute the entire agreement between Heal Now India and the patient regarding the use of our facilitation services and supersede any prior discussions, representations, or communications relating to such services.
